Digital Millennium Copyright Act (DMCA) Policy

Swift Media ("OSU AI") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.

IMPORTANT: To qualify for DMCA safe harbor protection, you must register your designated agent with the U.S. Copyright Office. This policy alone is not sufficient. Visit copyright.gov to complete registration.

1. REPORTING COPYRIGHT INFRINGEMENTS (TAKEDOWN NOTICE)

If you are a copyright owner, or authorized to act on behalf of one, and you believe that material available on OSU AI infringes your copyright, please submit a Notice to our Designated Copyright Agent containing the following:

  1. Identification of the Work: A description of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
  2. Identification of the Material: A description of where the allegedly infringing material is located on our service (e.g., a specific URL, user account, or texture/schematic identifier).
  3. Contact Information: Your full legal name, mailing address, telephone number, and email address.
  4. Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy Statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  6. Signature: Your physical or electronic signature.

2. COUNTER-NOTICE (IF YOUR CONTENT WAS REMOVED)

If you believe your content was removed by mistake or misidentification, you may submit a Counter-Notice to our Designated Agent containing:

  1. Identification: Identification of the material that was removed and its location before removal.
  2. Perjury Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or San Francisco, CA if outside the US) and that you will accept service of process from the original complainant.
  4. Signature: Your physical or electronic signature.
  5. Contact Info: Your full legal name, mailing address, telephone number, and email address.

Upon receipt of a valid Counter-Notice, we will forward it to the original complainant. If the original complainant does not notify us within 10-14 business days that they have filed a court action, we may restore the removed material.

3. REPEAT INFRINGER POLICY

In accordance with the DMCA and other applicable law, it is OSU AI's policy to terminate the accounts of users who are found to be repeat infringers of copyright in appropriate circumstances. We may also limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

3.1 Strike System

OSU AI implements the following strike system for copyright violations:

  • First Strike: Warning and content removal
  • Second Strike: Temporary account suspension (7 days) and content removal
  • Third Strike: Permanent account termination

Strikes remain on your account indefinitely. We reserve the right to immediately terminate accounts for egregious violations without following this strike system.

4. GOOD FAITH & MISREPRESENTATION

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

We encourage you to consult with a legal professional before filing a DMCA notice or counter-notice.

5. AI-GENERATED CONTENT CONSIDERATIONS

OSU AI provides tools for AI-generated textures, schematics, and other content. Please note the following considerations specific to AI-generated content:

  1. Prompt-Based Generation: If your copyrighted work was allegedly used as a prompt or reference to generate infringing content, please include details about how the generated content infringes your specific copyright.
  2. Similarity Claims: AI-generated content may coincidentally resemble existing works. We evaluate each claim on its merits.
  3. Training Data: Claims regarding AI training data should be directed to the AI model providers, not OSU AI, unless OSU AI trained the specific model in question.

6. NOTIFICATION PROCEDURES

Upon receiving a valid DMCA takedown notice, OSU AI will:

  1. Remove or disable access to the allegedly infringing material;
  2. Notify the user who uploaded or created the content that it has been removed;
  3. Provide the user with information about filing a counter-notice; and
  4. Record the incident for our repeat infringer policy.

7. MODIFICATIONS TO THIS POLICY

OSU AI reserves the right to modify this DMCA Policy at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified policy.
